Police Brutality: PEKIN Three Tazewell County jailers accused of using excessive force against a female inmate last fall have been absolved of the administrative charges against them and ordered reinstated with back pay.

But Tazewell County Sheriff Bob Huston said Tuesday that he will fight that ruling in circuit court in an attempt to have correctional officers Jeffrey Bieber and Justin Piro and Sgt. Richard Johnston permanently removed from their positions at the jail.

All three have been on administrative leave since October, when Becky Behm was brought to the jail after her arrest on drunken driving charges in Creve Coeur shortly after midnight Oct. 17.

By 5:30 a.m., she had been swung into a concrete wall head-first by Piro, punched in the face by Bieber and pepper sprayed on Johnston’s order.

The incidents have been the subject of hearings before the Tazewell County Sheriff’s Merit Commission since late last year, though those hearings didn’t begin in earnest until May. Huston wanted the commission to allow him to terminate the jailers.

Attorneys for the officers were scheduled to begin presenting evidence for their clients Tuesday morning, but instead asked the commission to make a direct finding of not guilty and reinstate the jailers to their jobs with back pay.

The commission unanimously agreed.

“I felt after the prosecution was done that they didn’t prove their case – any of it,” commissioner Harvey Richmond said. “We all felt – what we saw in (the video), she would not do anything that they told her – they used only the minimal force that was needed to control her.”

Richmond, a former deputy, said the commission didn’t need to hear testimony presented by the officers’ attorneys to find them innocent of the charges leveled against them by the sheriff because of Behm’s behavior.

“If she at any time would have complied, she would have been out of there in half an hour,” Richmond said. “If I would have seen something that I think was way out of line with the situation, I would have gone the other way, but I didn’t see it.”

Richmond said the 30-minute portion of the video shown during Behm’s testimony in May needed to be examined very closely and in the context of the several hours before that footage to better understand the situation officers were trying to control.

But Huston maintained Tuesday that the 30-minute segment, which he released to media outlets after the ruling, was enough to justify the officers’ termination. In the first couple of days after the incident, he called it the worst case of unnecessary force he’d seen in a decade as sheriff.

“I can not understand how anyone can watch the video of that incident and just let them all go,” Huston said after the ruling Tuesday. “I believe that officers should be held to a high standard of conduct, but not to impossible or unattainable standards. Today, the merit commission refused to hold them to even the lowest standards of conduct or even to basic human dignity.”

Attorneys for the jailers couldn’t immediately be reached for comment later Tuesday.

Behm, who testified before the commission in May, said she couldn’t recall most of the night at the jail and had no specific recollection of the beatings in a segregation cell in the A-block of the jail.

She said she had drank four or five beers at Behmer’s Dugout, the Peoria bar she owns, over the course of about five hours before her arrest by a Creve Coeur police sergeant on suspicion of drunken driving.

Piro and Bieber claimed in their testimony before the commission that Behm was extremely intoxicated and belligerent and had to be transferred to the segregation cell to maintain order in the usual holding area.

Piro eventually swung Behm head-first into a concrete wall but testified that he was attempting to execute a sanctioned “takedown” technique and lost his balance. Bieber punched Behm in the face, but he claimed she attempted to leave the cell and lunged at him.

The merit commission’s rejection of Huston’s charges is the second such outcome for a high-profile Tazewell County case. The commission in December vetoed Huston’s request to fire Deputy Jeff Bass for neglecting his duties and intimidating his superiors, though Bass was found guilty of those offenses.

Huston said he will appeal Tuesday’s decision because he believes he was denied a fair hearing and the result was contrary to the evidence.

Police Brutality: How does a law-abiding mom driving home with two kids end up being Tasered, handcuffed and arrested — while her children are left alone for 40 minutes in the car, waiting for someone to come get them?

Thats a question that Audra Harmon hopes will be answered by a lawsuit she has filed against the Onondaga County (N.Y.) Sheriffs Department. In the process, she and her attorney told TODAYs Meredith Vieira Friday in New York, they hope to spur a debate over whether police should be carrying Tasers at all.

The suit, seeking unspecified monetary damages on an array of charges including false arrest and police brutality, has been filed, said attorney Terrance Hoffman, to bring awareness not only that anybody can be a potential victim, but also awareness to the police officers who have the Tasers to be a little more judicious and think it out a little more before they use this kind of device. Then the overall picture is whether or not Tasers should be used in law enforcement.

First look at articles that discuss what Fascism or Tyranny actually is. Wikipedia has an article that addresses this topic. Fascism is defined as a political ideology that seeks to combine radical and authoritarian nationalism with a corporatist economic system and is usually considered to be on the far right of the traditional left-right political spectrum. Tyranny is a form of government that is led by one who has taken power by his or her own means. This is as opposed to hereditary or constitutional power. In modern terms, this is used to describe a harsh or cruel ruler who places his or her own interests or the interests of a small oligarchy over the best interests of the general population.

When we look at the actions this and the previous administration have taken it is easy to argue that we really have a one party system. The Bush administration began the TARP program to solve a problem that the market could have handled on its’ own. The government stepping in and propping up institutions with tax payer money and or debt that is created without authorization from the people is unconstitutional. The argument that AIG was too big to fail is ridiculous. AIG had a private buyer that would have bought it as is and then sold the pieces that were not profitable. This would not have involved any action by the government. This was the trip wire that was used to allow government control on an industry, insurance, that touches every aspect of our country.

This process was expanded by the Obama administration to include, banks, automobiles and now every aspect of healthcare. The rule of law means little and contracts can be voided as they chose. Bondholders were left holding their units in their hands while unions and the government took over GM and Chrysler. This is an amazing move that was allowed by the courts. To this point, it has been largely ignored. Employees of companies were told that the compensation they had earned as agreed upon would not be paid. Think how you would react, if you had worked all year for an hourly rate and your employer said that would be retroactively rescinded. You would go berserk. I am not saying that they executives compensation is fair or equitable but we are opening a Pandora’s Box when the government can dictate compensation. When you borrow money from the bank do they tell you how much you can spend on utilities, food and gas? Then why should the government, after the fact, be involved in details of a company? There is no valid reason other than expansion of government control in our lives.

The passage of the current healthcare bill is a continuation of this process. Individual lawmakers were bought off in the Senate to pass the bill. This is another example of the few benefiting at the expense of the many. The powers that be are dividing up the spoils based on who is in “power” at the time. You will be fined if you don’t purchase health insurance. The list goes on and on.

The American people can do things to change this. Here are a few ideas to work towards change:

  1. Avoid doing business with companies that are controlled by the government. Examples are GM. Chrysler, Citibank, J.P. Morgan Chase and Bank of America.
  2. Become involved in the political process. Be vocal with your representatives. Look for a third party option. Make sure if your representative does something you disagree with let them know.
  3. Be informed. Do not take any source of information as the one source of truth. Fox, CNN, NBC etc all have their own agenda. It does not mean everything they say is a lie or everything they say is the truth. Check the facts. Don’t be afraid to question your own biases.
  4. Find others with opposing views that can discuss things with an open mind.
